Chapter I General Provisions

Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on Energy Conservation and relevant laws and administrative regulations, in conjunction with the actual conditions of the province, in order to improve energy efficiency, save energy, protect the environment, develop a circular economy, and build a conservation-oriented society.

The second is to adhere to the principle of combining energy conservation with energy development and putting energy conservation at the forefront. Encourage the use of clean energy and develop new and renewable energy sources.

Article 3 The people's government at or above the county level shall formulate energy-saving plans according to the national economic and social development goals of the administrative region, rationally adjust the industrial structure, product structure and energy consumption structure, promote the progress of energy-saving technologies, and ensure the rational use of energy.

Article 4 The competent department of energy conservation of the people's government at or above the county level shall be responsible for the supervision and administration of energy conservation within its administrative region, and other relevant departments shall be responsible for the supervision and management of energy conservation within their respective areas of responsibility.

Article 5 Encourage and support the research and promotion of energy-saving science and technology, strengthen energy-saving publicity and education, popularize energy-saving scientific knowledge, and enhance the awareness of energy conservation for all.

Article 6 Any unit or individual shall fulfill its energy conservation obligations and have the right to report the act of wasting energy. The people's governments at all levels shall commend and reward units and individuals that have made outstanding contributions to energy conservation work and achieved significant energy conservation benefits.

The second chapter is about energy.

Article 7 Energy-using units shall abide by energy-saving laws, regulations and relevant state regulations, establish and improve energy-saving work responsibility systems and various energy management systems, adopt new energy-saving technologies, new processes, new products and new materials, and eliminate national energy consumption quotas. Old equipment, reducing energy consumption and saving energy.

Units and individuals that produce and sell energy-using products shall produce and sell products with low energy consumption, and stop production and sales of products that are explicitly eliminated by the state within the prescribed time limit.

Article 8 Energy-using units shall not have the following acts:

(1) New or expanded industrial projects or other projects that are backward in technology, consume too much energy, and seriously waste energy;

(2) using energy-using equipment that has been eliminated by the state;

(3) transferring the energy-using equipment that has been eliminated to others for use;

(4) Introducing backward energy-using technologies, equipment and materials;

(5) Exceeding the energy consumption limit of the unit product;

(6) Other acts that violate the state's energy regulations.

Article 9 The feasibility study of a fixed asset investment project shall be conducted on the basis of reasonable energy use.

The design and construction of fixed asset investment projects shall comply with reasonable energy use standards and energy conservation design specifications.

Article 10 Energy-using units in key energy-consuming industries such as iron and steel, non-ferrous metals, coal, electric power, chemicals, and building materials shall formulate energy-saving plans and implementation plans, and take effective measures to reduce energy consumption per unit of products and improve energy efficiency.

Article 11 encourages the production and use of energy-efficient motor vehicles, ships and agricultural machinery.

Motor vehicles and ships shall comply with national energy consumption standards; those exceeding national energy consumption standards shall be rebuilt or updated within a time limit.

Article 12 The design and construction of buildings shall implement mandatory standards for building energy conservation, and adopt energy-saving building structures, materials, appliances and products.

Energy-saving products should be used for the construction and renovation of public facilities such as urban lighting. Public places such as hotels, commercial buildings, and drama theaters should use high-efficiency energy-saving lighting products and energy-saving air-conditioning systems.

Encourage the installation and use of solar water heaters in new urban residential buildings. The installation of solar water heaters and water pipes should be designed and synchronized with the main project.

Article 13 The urban areas of cities with districts and other cities with conditions shall formulate thermal planning, phase out individual boilers, and promote centralized heating.

Article 14 Rural areas shall actively develop and utilize biomass energy and renewable energy such as biogas, straw gasification, straw power generation, promote the use of energy-saving stoves such as solar water heaters and fuel-saving coal, and rationally plan and develop small hydropower resources.

Article 15: Institutions, institutions, and organizations shall strengthen the energy management and energy-saving renovation of heating, cooling, and lighting systems in office spaces, and establish and improve energy-saving management systems for official transportation.

Article 16 Energy production, business units such as electricity, gas, natural gas and coal shall be measured and charged in accordance with state regulations, and shall not provide energy products or implement a fee system to employees and other residents of the unit at no cost or at a low price.

Article 17 Products that implement energy efficiency labeling management shall be marked with an energy efficiency label; if not marked, they shall not be sold.

Encourage the sale of products that pass the energy-saving quality certification.

Government procurement should give priority to purchasing energy-saving products.

Article 18 Encourage the development and utilization of renewable energy such as solar energy, water energy, wind energy and biomass energy, and low calorific value fuels such as coal slime, coal gangue and stone coal to reduce non-renewable energy consumption.

Promote the use of new and clean energy sources such as ethanol gasoline.

The third chapter can guarantee

Article 19 The people's governments at or above the county level shall nurture and standardize the energy-saving technology market, establish and improve energy-saving technical service systems, implement market-oriented energy-saving technical services such as contract energy management, and encourage and support enterprises, scientific research institutions, institutions of higher learning, etc. Personal research and development of new energy and renewable energy and energy-saving new technologies, new processes, new products, new materials.

Article 20 The people's government at or above the county level shall support the construction of energy-saving projects. The following major energy-saving projects should be prioritized into the government's fixed asset investment and scientific and technological research projects:

(1) Coal-fired industrial boiler (kiln) renovation project; (2) Regional cogeneration project; (3) Waste heat and residual pressure utilization project; (4) Saving and replacing petroleum engineering; (5) Motor system energy-saving project; 6) Energy system optimization project; (7) Building energy-saving project; (8) Green lighting project; (9) Energy-saving engineering for government agencies; (10) Energy-saving monitoring and technical service system construction project; (11) Priority for inclusion in the plan Other major energy-saving projects.

Article 21 The competent department of energy conservation of the provincial people's government shall, in conjunction with the relevant departments of science and technology of the provincial people's government, determine the key points and directions of advanced energy-saving technologies suitable for promotion and application, organize the implementation of energy-saving demonstration projects, and regularly publish and promote the use of energy-saving technologies and product lists.

Article 22 The provincial people's government shall arrange energy-saving funds, and the municipal and county people's governments shall arrange energy-saving funds according to actual conditions for the rational use of energy, the development of new energy and renewable energy, and energy-saving publicity, training, monitoring, and rewards. Wait.

Where waste heat, geothermal heat, mine gas, inferior coal, coal slime, coal gangue, combustible garbage, etc. are used for power generation and heat supply, the relevant departments shall provide preferential and support in terms of taxation and credit in accordance with relevant state regulations.

Article 23 The key energy-using units shall arrange funds for energy-saving scientific research and development, energy-saving technological transformation and energy-saving publicity, training, monitoring, and rewards.

Article 24 Energy-using units shall carry out energy-saving education and organize relevant personnel to participate in energy-saving training. Personnel who are not educated or trained in energy conservation shall not work in the operation of large-scale energy-consuming equipment.

Article 25 The key energy-using units shall establish energy management positions, and their energy management personnel shall have energy-saving professional knowledge, practical experience and technical titles of engineers and above, and shall file with the energy-saving competent departments of the people's governments at or above the county level and relevant departments for the record. A qualified energy-using unit with a conditional focus can establish an energy management agency.

Refer to the energy-using units managed by key energy-using units, and can be equipped with professional energy management personnel.

Article 26 All kinds of technical service institutions with the technical conditions for inspection and testing may be entrusted by the energy-using units to conduct energy-saving monitoring services according to law. Data and analysis reports on energy conservation monitoring should be truthful, reliable, objective and fair.

The fourth chapter can supervise

Article 27 The people's governments at all levels shall strengthen their leadership over energy conservation work, regularly deploy, coordinate, supervise and inspect energy conservation work, and incorporate energy conservation goals and task completion into the government's annual assessment.

Article 28 The main duties of the energy-saving competent department in supervising and managing energy-saving work:

(1) Organizing and implementing energy conservation laws and regulations; (2) proposing energy conservation policies and measures;

(3) Preparing a draft energy conservation plan and formulating an implementation plan for the energy conservation plan;

(4) Supervising and inspecting the energy utilization status of the energy-using units;

(5) Organizing and coordinating the promotion and application of new energy-saving technologies, new processes, new products and new materials;

(6) Carry out energy conservation publicity, education, training, etc.; (7) Other duties as stipulated by laws and regulations.

Article 29 shall implement hierarchical supervision and management of the energy utilization status of energy-using units.

The energy consumption unit of the provincial people's government is the key energy-using unit with an annual comprehensive energy consumption of more than 10,000 tons of standard coal and the energy-saving competent department of the provincial people's government. The energy-using unit with an annual comprehensive energy consumption of more than 5,000 tons and less than 10,000 tons of standard coal is the key energy-using unit. Department supervision and management.

The energy-using units with an annual comprehensive energy consumption of more than 5,000 tons and less than 10,000 tons of standard coal, which are not designated by the energy-saving department of the provincial people's government, shall be supervised and managed by the energy-saving department of the municipal or county people's government with reference to the key energy-using units.

The energy-using units with an annual comprehensive energy consumption of less than 5,000 tons of standard coal shall be supervised and managed by the energy-saving department of the municipal and county-level people's governments.

Article 30 The energy-using units with an annual comprehensive energy consumption of 5,000 tons of standard coal or above shall establish and improve the energy consumption statistics and energy utilization status reporting system, and report to the energy-saving competent departments of Shengshi and county-level people's governments before the end of January each year. Send the annual energy use report.

Article 31 The energy-saving competent department of the people's government at or above the county level may, according to the needs of the work, entrust an energy-saving monitoring agency with the technical conditions for inspection and testing to monitor the energy utilization status of the energy-using unit according to law. The monitored unit may not refuse to monitor. The entrusted energy conservation monitoring agency shall not charge the monitored unit.

Article 32 The energy conservation department and the quality and technical supervision department of the people's government at or above the county level shall, within the scope of their respective duties, strengthen the supervision and inspection of the use of energy-saving quality certification marks and energy efficiency labels, and announce the results to the public.

No unit or individual may use the forged energy-saving quality certification mark and energy efficiency mark, or use the energy-saving quality certification mark and energy efficiency mark.

Article 33 The competent department of energy conservation of the provincial people's government shall, in conjunction with the departments of quality and technology supervision, formulate energy consumption limits for unit products for products with high energy consumption in the production process, and announce them to the public.

The competent department of energy conservation of the people's government at the city or county level shall organize relevant departments to inspect the implementation of the energy consumption limit of the unit product and submit the inspection results to the energy conservation department of the people's government at the next higher level.

Article 34 The quality and technical supervision department of the provincial people's government may, in accordance with the actual conditions of the province, work with relevant departments to formulate local energy conservation standards.
Encourage and guide enterprises to develop enterprise energy conservation standards that are stricter than national, industry or local standards.

Article 35 The competent statistical department of the people's government at or above the county level shall do a good job in the statistical work of energy consumption and utilization status, conduct analysis and research on relevant data, and regularly publish the bulletin on the energy consumption of unit products of major energy-consuming products.

The competent departments of statistics and energy conservation and relevant industry management departments shall cooperate with each other to establish a scientific energy management information system and improve the utilization rate of energy information.

Article 36 The people's government at or above the county level shall improve the energy price monitoring system, use price levers according to law, regulate energy use, and promote energy conservation.

Chapter V Legal Liability

Article 37 In case of violation of the provisions of the first paragraph of Article 12 of these Regulations, if the design of a building fails to adopt energy-saving building structures, materials, appliances and products in accordance with the national compulsory standards, the competent department of construction of the people's government at or above the county level shall order it. The design unit shall make corrections within a time limit; if it fails to make corrections within the time limit, it shall be given a warning and impose a fine of not less than 100,000 yuan but not more than 300,000 yuan; if the loss is caused, it shall be liable for compensation according to law.

If the construction of a building fails to adopt energy-saving building structures, materials, appliances and products according to the design requirements, the competent department of construction of the people's government at or above the county level shall order it to make corrections within a time limit, and the construction unit shall be subject to a project contract price of 2%% or more and 4%% or less. Fine; if the circumstances are serious, order to suspend business for rectification, reduce the qualification level or revoke the qualification certificate.

Article 38: In violation of the provisions of Article 16 of these Regulations, energy, gas, natural gas, coal and other energy production and business units shall provide energy products or low-cost system to employees and other residents of the unit without compensation or low price. The competent department of energy conservation of the people's government at or above the county level shall order it to make corrections within a time limit; if it fails to make corrections within the time limit, it shall impose a fine of not less than 10,000 yuan but not more than 50,000 yuan.

Article 39 If a technical service institution that conducts energy-saving monitoring provides false data and an analysis report in violation of the second paragraph of Article 26 of these Regulations, the energy-saving department of the people's government at or above the county level shall order it to make corrections and give a warning; Serious, can be imposed a fine of 2,000 yuan or more and less than 10,000 yuan.

Article 40 In case of violation of the provisions of Article 31 of these Regulations, if the monitored unit refuses to monitor, the competent department of energy conservation of the people's government at or above the county level shall order it to make corrections within a time limit and notify it.

Article 41. In violation of the provisions of the second paragraph of Article 32 of these Regulations, the use of forged energy-saving quality certification marks and energy efficiency labels, or the use of energy-saving quality certification marks and energy efficiency indicators, the quality of the people's government at or above the county level The technical supervision department ordered the correction, confiscated the illegal income, and was able to impose a fine of more than one time and five times the illegal income.

Article 42 Anyone who refuses or obstructs energy-saving law enforcement personnel from performing official duties according to law and violates the Law of the People's Republic of China on Public Security Punishment shall be dealt with by the public security organs according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 43. State organs and staff members of business organizations that manage energy-saving public affairs abuse administrative powers, neglect their duties, and engage in malpractices for personal gains in energy-saving work shall be given administrative sanctions according to law; if they constitute a crime, they shall be investigated for criminal responsibility according to law.

Chapter VI Supplementary Provisions

Article 44 These Regulations shall come into force on July 1, 2006.
